Terms of accommodation for guests of Ferienhaus Kollinger

Basis of the contract

For the accommodation contract between Ferienhaus Kollinger (owner Christian Riedlsperger, address see § 1) and the guest, the General Terms and Conditions for the Hotel Industry (AGBH 2006) as currently published apply, as recommended by the Hotel Industry Trade Association of the Austrian Federal Economic Chamber.

Supplementary or deviating from the AGBH, the following special arrangements apply to Ferienhaus Kollinger.

Special arrangements

2. Accommodation property and minimum stay

Rented out is the holiday home "Kollinger" at 5710 Kaprun, Menggweg 2, with 4 bedrooms for up to 8+2 guests. The agreed minimum stay is 3 nights; during the off-season shorter stays are possible by arrangement.

3. Rental price and payment terms

The agreed rental price is per night in euros, including statutory VAT, and covers the following services:

Down payment: 30 % of the total amount within 7 days of receiving the reservation confirmation.
Balance: 30 days before arrival; for short-notice bookings immediately after confirmation.

Not included in the rental price: local tourism tax according to the current rates of the municipality of Kaprun, settled on site or together with the balance payment.

4. Arrival and departure (deviating from § 7 AGBH)

Check-in: from 16:00 on the day of arrival
Check-out: by 10:00 on the day of departure

Deviations are possible by prior arrangement. If arrival is after 18:00, the host must be informed in good time.

5. Cancellation fees (deviating from § 8 AGBH)

In the event of cancellation of the accommodation contract by the guest, the following cancellation fees apply (as a percentage of the total travel price):

We recommend taking out travel cancellation insurance.

6. House rules (supplementary to § 9 AGBH)

7. Pets

Pets may be brought along by prior arrangement and against a surcharge if so agreed. They must not be left unattended in the holiday home. Any damage or additional cleaning effort will be invoiced separately.

8. No statutory right of withdrawal (FAGG)

Pursuant to § 1 sec. 2 no. 9 of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no statutory right of withdrawal for accommodation contracts when a specific date or period of performance has been agreed. The cancellation arrangements set out in § 5 of these terms apply.

9. Place of jurisdiction and applicable law

Austrian substantive law applies exclusively, to the exclusion of the conflict-of-laws rules of private international law and of the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Salzburg, Austria. For consumer transactions the mandatory jurisdiction rules of the Austrian Consumer Protection Act (KSchG) apply.

10. Data protection

Personal data is processed in accordance with the applicable data protection regulations. For details see our privacy policy.

11. Online dispute resolution

Consumers have the option of submitting complaints to the EU online dispute resolution platform: ec.europa.eu/consumers/odr.

12. Severability

Should individual provisions of these special arrangements be wholly or partially invalid, the validity of the remaining provisions as well as of the underlying AGBH shall remain unaffected. Amendments and supplements require the written form.
